2010 Exhibitor Contract
The Exhibitor listed below (hereinafter referred to as “Exhibitor”) hereby agrees to the following terms and conditions for the 24th Annual Piedmont Racing Expo & Auction, (hereinafter referred to as “Event”) as set forth in this contract by Walker Auctions, LLC, a North Carolina LLC, d/b/a Phillip Walker Auctions, (hereinafter referred to as “Promoter”) for expo/trade show sponsorship and/or exhibit space. This contract shall be in effect for the following event(s):
Piedmont Racing Expo & Auction,
Friday-Saturday, Jan 15-16, 2010
Exposition Center, NC State Fairgrounds
(property owner), Raleigh, NC
SHOW HOURS: 1--9:30 PM, Friday, and 8-5 PM, Saturday
CONSIGNMENT CHECK-IN: 10AM-8PM Wednesday,
January 13 and 10AM – 8PM Thursday, January 14, 2010
EXHIBITOR SETUP: 12-8PM Thursday, January 14 (all trailers and large exhibits
should be in on Thursday), and 8AM-12 Noon, Friday, January 15, 2010 (Smaller
and more mobile exhibits...trailer exhibits need to be placed on Thursday)
The Exhibitor agrees to sponsorship of events and/or rental of retail booth space in the Event as indicated below:

Exhibitor will setup from Noon – 8 PM on Thursday prior to the event (preferred for Bulk Space Exhibitors or those with trailers or vehicles in their exhibit) or Friday 8AM – 12 Noon on Friday for all others. Teardown will be permitted after 4 PM on Saturday, unless otherwise designated by the Promoter. Premises must be vacated no later than 9:30 PM on Saturday.
A non-refundable deposit of Fifty Percent (50%) of rental payment and signed contract is required to reserve sponsorship and exhibit space. When feasible, Exhibitors will have their name(s) appear on pre-auction print and media advertising. Balance is due before occupying space.
Exhibitor may display and sell new merchandise only, as long as display is within bounds of good taste as determined by the Promoter. No used merchandise will be allowed in Exhibitor’s rental space. Exhibitor is responsible for any tax, licenses, fees, or other obligations as required for doing business by state law. Exhibitor is solely responsible for the space assigned. The Promoter nor the property owner is responsible and will be held harmless from any loss or theft to any person or damages thereto.
Exhibitor will furnish customers with a paid receipt for items or merchandise sold. Customers may be required to present receipt upon leaving the facility. Please note that the Exhibitor is responsible for advising his customers of such and that purchased items may not be carried throughout the building. (Early or large purchases should be held by the Exhibitor until customer is ready to leave the facility)
Promoter has the right to place reasonable restrictions on noise coming from any Exhibitor’s booth or personal conduct of Exhibitor and/or his employees.
No food/drink concessions may be sold by any Exhibitor. Food and/or drink samples must comply with Property Owner rules and restrictions (such as size of sample), and must be approved by Promoter.. The property owner has an exclusive food vendor for all events.
Should said premises be destroyed by fire or the elements, or by any other cause, or in the case of government intervention or regulation, military activity, strikes, or any other circumstances that should make it impossible for the Promoter to conduct said Event at the time and place provided, this agreement shall terminate and Exhibitor shall and does hereby waive any claim for damage or compensation except the Promoter return of the amount paid, after deduction of actual expenses incurred in connection with the Event and there shall be no further liability on the part either party.
